§ 1 Contracting party and scope
These General Terms and Conditions (GTC) apply to all contracts for the temporary provision of a parking space in the private underground car park PARKEN IN BAABE in 18586 Ostseebad Baabe on the island of Rügen.
They apply to both consumers and entrepreneurs. A consumer is any natural person who concludes a legal transaction for purposes that cannot predominantly be attributed to their commercial or self-employed professional activity. An entrepreneur is any natural or legal person or partnership with legal capacity who acts in the exercise of their commercial or self-employed professional activity when concluding the contract.
The operator and contracting party of the customer is:

The contracting party on the customer's side is the person making the booking. This also applies if the parking space is used by another person.
Bookings are made exclusively online via the central booking system embedded in this website. The website itself is not the booking system.
Deviating, conflicting or supplementary conditions of the customer only become part of the contract if the operator has expressly agreed to their validity in writing.
§ 2 Definitions
Only the following terms are used in these General Terms and Conditions:
- Booking: the binding online booking of a parking space via the central booking system.
- Booking confirmation: the booking system's confirmation of the booking that has come about.
- Booking number: the number issued by the booking system to identify the booking.
- Cancellation: the early termination of a booking before the start of, or during, the booked period.
§ 3 Subject matter of the contract
The subject matter of the contract is exclusively the temporary provision of a parking space in the private underground car park in Baabe.
This is a rental agreement for a parking space.
No safekeeping of the vehicle takes place.
No guarding and no monitoring of the vehicle takes place.
The operator assumes no duty of care with regard to the parked vehicle.
Further services, in particular cleaning, maintenance, refuelling or securing of the vehicle, are not owed.
§ 4 Booking and conclusion of contract
Bookings are made exclusively online via the central booking system.
The booking system for Baabe can be reached at: https://parken.baltic-city-spaces.com/kalender?site=baabe.
By completing the booking process, the customer submits a binding offer to conclude a rental agreement for the selected parking space and period.
The contract comes into effect upon receipt of the booking confirmation.
The customer is obliged to provide correct and complete information when booking.
Use of the parking space requires payment in full.
The operator is entitled to reject a booking, in particular if no parking spaces are available for the desired period.
§ 5 Prices and payment
The prices displayed in the booking system at the time of booking apply.
Payment is made using the payment methods actually offered in the booking system. Which payment methods are available is determined by the respective booking process.
Payment is processed entirely within the booking system and not on this website.
Use of the parking space requires payment in full.
§ 6 Booking period
The parking space may be used exclusively during the booked period.
The booking period begins at 00:01 on the arrival day and ends at 23:59 on the departure day.
The customer must carefully check the booking dates before completing the booking.
§ 7 Permitted vehicles
Properly registered and roadworthy vehicles are permitted, provided the dimensions of the underground car park and the parking space are observed.
The current guide values are:
- Entrance: approx. 2.99 m width, approx. 2.20 m height, approx. 20.53 m length
- Parking space: approx. 2.60 m width, approx. 2.20 m height, approx. 5.00 m length
These figures are approximate values.
Vehicles must not exceed the permitted dimensions.
Motorhomes and vehicles over 3.5 tonnes are not permitted.
Vehicles with leaking operating fluids or significant technical defects must not be parked.
For larger vehicles, express approval must be obtained before booking unless they are clearly within the stated dimensions.
The customer is responsible for checking, before booking, whether their vehicle including bodywork and permanently attached vehicle parts is suitable for the parking space.
§ 8 Electric vehicles and charging
Charging electric vehicles, e-bikes, e-scooters or other battery-powered devices is not permitted in the underground car park.
No charging facility exists and none is owed.
§ 9 Access
Access to the underground car park is via the designated electronic access system.
The access code or access information is transmitted in accordance with the technical booking process.
The customer must treat access data as confidential.
Passing on access data without authorisation is not permitted.
In the event of loss of the access data or faults with access, the operator must be informed without delay using the contact details given in § 1.
§ 10 Parking space
The customer may use exclusively the parking space intended for the booking or the parking space allocated to them.
There is only a right to a specific parking space if this is expressly part of the booking.
The vehicle must be parked within the boundaries of the allocated parking space.
Access routes, traffic areas and other parking spaces must not be blocked.
§ 11 Rules of use
The following applies in particular in the underground car park:
- walking pace
- consideration for other users
- no engines left running unnecessarily
- no repair work
- no refuelling
- no open flames
- no smoking
- no camping
- no overnight stays
- no storage of items outside the vehicle
- damage must be reported without delay
The parking space and the facilities of the underground car park must be treated with care.
Waste must not be left behind.
§ 12 Liability
The underground car park is not a guarded car park.
The operator does not assume safekeeping of the vehicle.
Statutory liability for intent and gross negligence remains unaffected.
For damage caused by other users or third parties, liability is generally excluded to the extent permitted by law.
Exclusions of liability apply only to the extent permitted by law.
There is no blanket exclusion of liability that is mandatory by law.
Statutory liability for injury to life, body or health and under the Product Liability Act remains unaffected.
The customer is liable under statutory provisions for damage caused culpably by themselves or by persons they permit, in particular to the facilities of the underground car park, to other vehicles or to third-party property. Damage must be reported without delay.
§ 13 Breach of contract
In the event of significant breaches of these Terms and Conditions or the house rules, further use of the parking space may be prohibited.
Vehicles parked without authorisation or contrary to the applicable rules may be removed in accordance with the statutory requirements.
The costs of a justified removal may be imposed on the responsible party.
Further statutory rights of the operator remain unaffected.
§ 14 Cancellation
In principle, a cancellation is only possible in accordance with the conditions applicable to the respective booking.
In principle, there is no right to a refund in the event of:
- non-arrival
- late arrival
- early departure
- non-use of the booked parking space
Statutory claims remain unaffected.
This must be distinguished from any cancellation protection: it is not offered via this website and is not part of these Terms and Conditions, but is offered exclusively in the central booking system. Its conditions are displayed exclusively there during the booking process.
§ 15 Non-arrival
In the event of non-arrival, there is in principle no right to a refund of the booking price.
This also applies if the booked parking space is not used.
Non-arrival is not a cancellation.
Statutory claims remain unaffected.
§ 16 Early departure
In the event of early departure, there is in principle no right to a pro rata refund.
Statutory claims remain unaffected.
§ 17 Late arrival
In the event of late arrival, the booked period is not automatically extended.
There is in principle no pro rata refund for late arrival.
Statutory claims remain unaffected.
§ 18 Use after the end of the booking
After the booked period has expired, there is no right to further use of the parking space.
Further use requires a corresponding new booking or express approval.
The vehicle must be removed from the parking space at the latest when the booked period expires.
§ 19 Force majeure and unavailability
Should the booked parking space be temporarily or permanently unusable due to circumstances beyond the operator's control, the customer will be informed of this.
Amounts already paid will be refunded for the period during which use was not possible, unless alternative provision is agreed or offered.
Further claims exist only within the scope of statutory liability.
§ 20 Right of withdrawal
To the extent that the statutory requirements for an exception to the right of withdrawal for services related to a specific period or point in time are met, there is no statutory right of withdrawal.
The specific legal classification depends on the statutory requirements of the individual case.
Separate withdrawal instructions deviating from this are not provided.
The customer's statutory rights remain unaffected.
§ 21 Data protection

§ 22 Consumer arbitration
There is no obligation and in principle no willingness to take part in dispute resolution proceedings before a consumer arbitration board, unless there is a statutory obligation to do so.
The consumer's statutory rights remain unaffected.
§ 23 Place of jurisdiction
For consumers, the statutory provisions on jurisdiction apply.
If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is Potsdam, to the extent permitted by law.
§ 24 Applicable law
The law of the Federal Republic of Germany applies.
In relation to consumers, this applies only insofar as it does not restrict mandatory consumer protection provisions of the country in which the consumer has their habitual residence.
§ 25 Final provisions
Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions remains unaffected.
The statutory provisions apply in place of the invalid provision.
These Terms and Conditions apply in the version published at the time of booking.
